New Delhi, August 6

An application has been moved in the Supreme Court seeking early hearing of the politically-sensitive Rs 64 crore Bofors pay-off case after a fresh media report suggesting a financial quid pro quo for the Rs 1,437 crore Howitzer gun deal in 1986.

The plea by BJP leader and advocate Ajay Agrawal has also alleged apparent collusiveness by CBI with the accused persons in the Bofors scam, saying the agency did not challenge the Delhi High Court’s May 31, 2005 judgment quashing all charges against the Europe-based Hinduja brothers.

He has challenged the judgment in the apex court which had on October 18, 2005 admitted his petition that was filed after the CBI failed to approach the top court with the appeal within the 90-day deadline after the High Court verdict.

In the application, the lawyer-turned-politician said he had filed the appeal in public interest because the CBI did not come forward and it was reported that the Law Ministry then had not given permission to the agency, despite the fact that the High Court order was illegal.

To substantiate the allegation of collusiveness between the CBI and the accused persons, Agrawal in his application has narrated the sequence of events that led to the defreezing of the London bank account of Italian businessman Ottavio Quattrocchi, alleged middleman in the deal, in 2006, for which the then Additional Solicitor General B Dutta had visited England.

He said such a step was undertaken despite the fact that the then UPA government and the CBI were aware that his appeal has been admitted by the apex court.

Agrawal, who had contested the Rai Bareli Lok Sabha elections in 2014 against Congress President Sonia Gandhi, also claimed that the CBI did not bother to inform the Chief Metropolitan Magistrate, which was seized of the Quattrocchi matter, to inform about its move to defreeze the accounts.

He said that on August 3, he had written a letter to the CBI seeking re-investigation of the entire Bofors scam and the trail of alleged bribe money deposited in Quattrocchi’s London bank account and the subsequent developments after the defreezing of the account on January 16, 2006.

Fresh developments assume significance in the wake of a demand in Parliament by ruling BJP MPs for reopening of the probe into the Bofors kickback scandal after the media reports quoting Swedish chief investigator Sten Lindstrom’s suggested payment of alleged bribery at the top level.

After the developments in Parliament, Agrawal also wrote a letter to the Enforcement Directorate seeking investigation into the trail of the kickback money under the Foreign Exchange Management Act (FEMA), 1999 and the Prevention of Money Laundering Act, 2002.

In the July 28 letter to the ED, he claimed that the alleged crimes were committed continuously till 2006 when two London accounts held by Quattrochi, who has been accused as one of the middlemen in the deal, were de-freezed.

The BJP leader said the CBI should file an affidavit about the facts and course of investigation into the case, as during the brief hearing on December 1, 2016, the agency had told the apex court that the authorities had not permitted it to file an appeal against the May 31, 2005 verdict.

He said he would try to convince the apex court through his petition that the “High Court had quashed the charges against the accused persons on technical grounds and the order was totally perverse which is liable to be set aside.” Justice R S Sodhi, since retired, of the Delhi High Court had on May 31, 2005, quashed all charges against the Hinduja brothers—Srichand, Gopichand and Prakashchand—and the Bofors company and castigated the CBI for its handling of the case saying it had cost the exchequer about Rs 250 crore.

Before the 2005 verdict, another judge of the Delhi High Court, Justice J D Kapoor (since retired) on February 4, 2004, had exonerated late Prime Minister Rajiv Gandhi in the case and directed framing of charge of forgery under Section 465 of the IPC against the Bofors company.

The matter was last listed on February 28 this year when it was adjourned.

The apex court had on October 18, 2005 allowed Agrawal to file an appeal against the high court verdict in the absence of any appeal by CBI.

The December 1, 2016 hearing had taken place after a gap of almost six years since August 12, 2010.

The Rs 1,437 crore deal between India and the Swedish arms manufacturer AB Bofors for the supply of 400 155mm Howitzer guns for Indian Army was entered on March 24, 1986.

The Swedish Radio on April 16, 1987 had claimed that the company had paid bribes to top Indian politicians and defence personnel.

The CBI on January 22, 1990, had registered the FIR for the alleged offence of criminal conspiracy, cheating, forgery under the IPC and other sections of the Prevention of Corruption Act against Martin Ardbo, the then President of AB Bofors, alleged middleman Win Chadda and Hinduja brothers.

It had alleged that certain public servants and private persons in India and abroad had entered into a criminal conspiracy between 1982 and 1987 in pursuance of which the offences of bribery, corruption, cheating and forgery were committed to the extent of Rs 64 crore in the contracts for the supply of Bofors guns.

The first chargesheet in the case was filed on October 22, 1999, against Chadda, Quattrocchi, then Defence Secretary S K Bhatnagar, Ardbo and the Bofors company. A supplementary chargesheet against Hinduja brothers was filed on October 9, 2000.

A special CBI court in Delhi On March 4, 2011, had discharged Quattrocchi from the case saying the country cannot afford to spend hard-earned money on his extradition which has already cost Rs 250 crore.

Quattrocchi, who had fled from here on July 29-30, 1993, has never appeared before any court in India to face prosecution. He passed away on July 13, 2013. The other accused who have died are Bhatnagar, Chadda and Ardbo. PTI


Fresh China warning: India sticks to diplomacy

India today reiterated that it would continue to engage with China through diplomatic channels to find a mutually acceptable solution to Doklam standoff. At a media briefing here, External Affairs Ministry spokesperson Gopal Baglay said India’s objective was to achieve peace and tranquility in India-China border areas and it could be achieved only through diplomacy. Baglay said India was upset with China for stalling the UN move to list JeM’s Masood Azhar a global terrorist. To a query, Baglay replied New Delhi would continue to engage with Beijing through diplomatic channels to find a mutually acceptable solution to the border tension in the Sikkim sector. “It has already been conveyed to China that peace and tranquility are required in border areas,” he said.External Affairs Minister Sushma Swaraj had yesterday said India would not negotiate on the border issue. “We are talking about bilateral relations with China. That is the only way to find a solution,” she had said.Reacting to Sushma’s statement in the Rajya Sabha, China said it had shown “utmost goodwill” over the prolonged military standoff with India in the Sikkim sector, but warned its “restraint” had a “bottom line”.China’s Defence Ministry spokesperson Ren Guoqiang said India must “immediately withdraw its trespassing troops”. “India must give up the illusion of its delaying tactic and immediately withdraw its trespassing troops to the Indian side of the boundary,” state-controlled Xinhua news agency quoted Ren as saying.The External Affairs Ministry had, in a statement yesterday, said peace and tranquility on the India-China border constituted an important prerequisite for the smooth development of bilateral relations.


Doklam was a potentially dangerous miscalculation

To avoid another fracas, India and China must work on border frameworks

The Doklam border crisis has ended as suddenly as it began. India announced both countries had agreed to disengage their troops from the plateau along the Sino-Bhutan border. Beijing said Indian troops were “retreating”, and that it would continue to patrol the area. The two statements are not contradictory. Patrolling up to a country’s claims area is allowed under the Sino-Indian agreements and will now de facto be applied to the Sino-Bhutanese border too. In effect, its status quo. China’s original sin was the decision to extend a road up to the plateau in violation of the 2012 border agreement. The proof of the pudding, however, will be in the eating. In other words, whether Beijing will seek to change the Doklam status quo in future remains to be seen. One will expect aggressive patrolling and verbal brickbats in the future by both sides. But sound and fury signify nothing. Keeping its troops and workers indoors is what will be the real measure of China’s intentions.

Doklam deserves some introspection on the part of India. Beijing seems to have assumed a passive Indian response to its initial construction efforts. Possibly New Delhi’s failure to respond to the initial Chinese action of demolishing two vacant Indian bunkers was misread. Or Beijing concluded that India would feel constrained about interceding on behalf of the territorial claims of a third country. Either way, there was a miscalculation that was potentially dangerous. The announcement of a withdrawal indicates neither side is interested in a wider conflict. But there needs to be some thought about the fact that their spheres of influence will brush against each other in third countries with increasing frequency. India and China should not see Doklam in terms of point-scoring but rather as a warning of the need for extending their border management framework across other borders as well.

Even as India and China remain locked in an intense standoff at the Doklam plateau in Bhutan, the military positioning of either side is in state of readiness with People’s Liberation Army (PLA) having quickly constructed some bunkers and added to fortifications in Tibet.Militarily, it’s classified as position of ‘no war and no peace’— not on the cusp of a war but literally ready to face the enemy in case of a war. The addition of fortifications means a signal for a battle.(Follow The Tribune on Facebook; and Twitter @thetribunechd)The Indian Army’s 33 Corps headquartered at Sukha near Darjeeling has three divisions—17th, 20th and 27th—that are tasked at the frontier along the Sikkim-Tibet border. Each division has some 12,000-13,000 men, along with elements of the artillery guns which played a key role in the Kargil dispute with Pakistan in 1999.  Not all of these divisions are forward deployed as they have couple of brigades that are normally forward located and that is same as before. The moves are “more of posturing”. The Indian Army has observed that PLA has indulged in quick construction of bunkers and other military fortifications in Tibet over the past few weeks.The critical point is how many troops have been acclimatised to be immediately inducted at higher altitudes, said sources. Doklam, the site of the standoff, is about 11,000 feet high. The brigades, though not forward deployed, maintain a number of troops who are acclimatised. The troops are stationed at varying depths from the border and there has been no movement that would be termed as fresh.Over the next three-four days, it will be known what stand India takes. Whether the People’s Liberation Army (PLA) delegations would be invited for the ceremonial border personnel meeting on August 15 is a decision not known yet. There are five such meeting points along the Line of Actual Control (LAC) and ceremonial meetings are hosted at these five points—Depsang in sub-sector north and Sappangur Gap (both on eastern Ladakh), Nathu La in Sikkim and Bum La and Kibithoo in Arunachal Pradesh. Ceremonial meetings are not like the usual flag-meetings. These are events to know each other socially. A lunch and a cultural show are hosted. China reciprocates with the same on its national day in October. 


EX­SERVICEMAN CHOPS OFF WIFE’S HAIR, BOOKED

TARNTARAN:The police have booked an ex-serviceman for chopping off his wife’s braid at Deenewal village, 10km from the district headquarters.

The incident took place on July 17 but the police registered a case of domestic violence on Saturday.

The accused has been identified has Dalbir Singh (37) alias Sodhi of Deenewal village. In her complaint to the police Rajwinder Kaur, 35, said she married Dalbir Singh 17 years ago. “He is an ex-service-man and is now working as a labourer, she said.

“Dalbir is addicted to drugs and alcohol. I often resist him from taking drugs as he beats me up in inebriated state,” she alleged.

She said on July 17, my husband again thrashed me in front of my father and chopped off my braid with a pair of scissors.

Assistant sub-inspector, Balwinder Singh said a case under Sections 323 (punishment for voluntarily causing hurt), 498-A (husband or relative of husband of a woman subjecting her to cruelty) of the IPC has been registered.

ROHTAK:National president of the Bharatiya Janata Party (BJP), Amit Shah, on Thursday applauded the armed forces for killing a record number of terrorists in Jammu and Kashmir. However, when asked about the increasing deaths of Indian soldiers post the surgical strikes, he said it was natural for the gunlaced enemy to retaliate.

“When a war is fought, people from both sides die. However, we have eliminated a record number of terrorists in our attempt to bring back peace in the Kashmir valley,” he said.

Shah was addressing a press conference in Rohtak on the second day of his three-day visit to Haryana wherein he is reviewing the functioning of the Manohar Lal Khattar-led BJP government.

DUCKS QUESTIONS OF SINO-INDIA STANDOFF

The BJP chief also praised the Centre’s foreign policy and claimed that it led to “isolating” Pakistan in the international community more than ever. He claimed that the government “broke the backbone” of terrorfunding with its demonetisation policy, followed by NIA raids and arrests of separatist leaders from Kashmir.

He, however, evaded questions on the month-long standoff with China in Dokalam, Sikkim, and the IT raids on Karnataka Congress minister, stating that ministers concerned have already answered them. Furthermore, Shah also evaded question about farm loan waiver in Haryana, saying that the Centre had clarified that it was for the states to decide on the matter.

 

Speaking on the ongoing stand-off between Punjab and Haryana over the Sutlej Yamuna Link Canal, Shah said the Centre will soon reintervene to facilitate talks with both the states to reach a settlement.

Tension has gripped the area near the International Border on Jammu frontier after a BSF constable was injured in firing by a sniper of the Pakistan Rangers on August 25.While the public movement has been stopped near the border, BSF personnel are also exercising extra caution. At the same time, a strong vigil is being maintained so as to foil any infiltration bid.Sources in the BSF said since the August 25 incident, even patrolling was being done with utmost caution. “We don’t want to give any chance to the Rangers to fire at us. At the same time, if anything happens, there will be a huge retaliation from our side,” said the sources.The 198-km-long International Border in Jammu frontier often gets volatile whenever Pakistan Rangers resort to unprovoked ceasefire violations. On August 25, Pakistan Rangers injured BSF constable KK Appa Rao during a sniping incident.In retaliation, BSF killed three Rangers on August 26. Since then the tension has increased and nobody is being allowed to go near the border fence. — TNS
