Dear All,
- As you know the pension fixation of those not retired in base year of 2013 for OROP – I (effective from Jul 2014 to Dec 2015) and base year 2018 for OROP -II (effective from Jul 2019 to Dec 2024) has to be carried out by two methods.
- First method is Fixation of Pension by Reduction by 3% per year.
- For example a Major retired with 21.50 years’ service in base year 2018 with pension of Rs 68,550. The pension of Major with 21 years of service Not Retired is to be reduced by 3% per year from the pension of Major with 21.50 years of service.
- PCDA (Pensions) Prayagraj instead of reducing the pension of Major with 21 years by 1.5% for six months which comes to Rs 66,836 fixed pension of Major with 12 years of service & invalided out of service with pension of Rs 51,700.
- The loss suffered by Majors, Lt Cols, Colonels and Brigadiers with certain length of service from Jul 2019 to Jun 2023 with is given in the detailed calculations which are attached. Some of them did not get any arrears in OROP-II
- The widows of such Majors, Lt Cols, Colonels and Brigadiers with certain length of service mentioned retired prior to Jun 2019 also suffered loss of pension. Some of them did not get any arrears in OROP-II
- The second method is to fix pension of same rank with longer length of service but not retired in base years with pension of those with lesser length of service but retired.
- Whichever method of pension fixation beneficial to those Not Retired in Base Year should have been fixed.
- PCDA (Pensions) Prayagraj cleverly fixed the pension of those Not Retired in Base Year 2018 by the second method which has caused immense loss to Majors, Lt Cols and Col TS.
- The loss suffered for the period of Jul 2019 to Jun 2023 for the following ranks is as shown below (detailed calculations are attached with varying length of pensionable servicec).
(a). Major with 21 years of service – Rs 9,19,981.
(b). Lt Col with 25 years of Service – Rs 2,08,946.
(c). Brigadier with 27.50 years of serevice- Rs 75,003. - A draft legal brief was sent to Col Indrasen Singh, our advocate in AFT, Principal Bench showing the detailed calculations. He informed few Majors have already contacted him for filing the case in AFT to get justice.
12 All the officers of the three ranks (Maj, Lt Col and Brigadier) whose qualifying service is shown in the detailed calculations who have lost out on correct pension (like Majors with service of 20, 20.50 and 21) are eligible to join the legal case of TSEWA intends to file soon in the Principal Bench of AFT, New Delhi. - Once you express your willingness to join the legal case of TSEWA, then Vakalatnamas (sample and blank) will be sent to you.
